Blackline's Privacy Policy
Blackline Service maintains robust privacy protections for any user of Blackline Service’s websites. Our Privacy Policy (“Privacy Policy”) is designed to help you understand how we collect, use and safeguard the information you provide to us and to assist you in making informed decisions when using our site “Site”.
For purposes of this Agreement, the terms “Blackline Service, we,” “us,” and “our” Blackline Service. “You”, “you”, “user”, and “your”, refers to you, as a, or the, user of our Site, including all subdomains, refers to Blackline Service’ website, which can be accessed at (blacklineservice.com). “Search” refers to Blackline services accessed via the Site, in which a user can search for chauffeured ground transportation services over its online platform.
PLEASE READ THIS PRIVACY POLICY AND OUR TERMS OF USE CAREFULLY. THE TERMS STATED IN THIS PRIVACY POLICY CONSTITUTE A BINDING LEGAL AGREEMENT BETWEEN YOU AND BLACKLINE SERVICE. BY USING THIS SITE AND THE RELATED SEARCH, YOU UNCONDITIONALLY AGREE TO BE BOUND BY THE TERMS STATED IN THIS PRIVACY POLICY AND OUR TERMS OF USE, INCLUDING ALL EXCLUSIONS AND LIMITATIONS OF LIABILITY, AND
WARRANT THAT YOU HAVE FULL AUTHORITY AND CAPACITY, LEGAL AND OTHERWISE, TO USE THE SEARCH. YOU MAY NOT ACCESS OR USE THIS SITE OR THE SEARCH IF YOU DO NOT AGREE TO ANY PART OF THESE TERMS. What information do we collect?
We may collect and use the following types of information from those who use the Site:
- Information by which you may be personally identified, such as your name, address, email address, phone number, billing and credit card information, and other information that may not be publicly available (“personal information”).
- Information about you that does not identify you personally, including, but not limited to, search requests for, communications with us and third parties, Site feedback or suggestions, search queries, product reviews, and any other activities when using the Site.
- Information you provide when you register with the Site, when adding or updating account preferences, and when using Search.
- Information about any of your transactions while using the Site.
We may combine information you provide us with other information about you that we obtain from your past use of the Site, from our business partners, and from other companies. We may access other information about you collected from third parties, such as social media and marketing companies. We will treat any non-personal information that is combined with personal information as if it were all personal information.
Automatic Data Collection
We collect the following types of information from you as you use the Site through automatic data collection technologies:
- Log file information commonly collected by host servers when you visit websites, including internet protocol (IP) addresses, browser type, Internet Service Provider (ISP), date and time stamps, referring/exit pages, domain names, landing pages, pages viewed, click counts, and similar information. This information is not connected to personal information and is used for purposes of administering the Site, analysing trends, tracking visitor activity, and collecting demographic data.
- Other details regarding your activities on the Site and Search, including your equipment, operating system, software, traffic information, and location data.
Our automatic data collection includes the use of the following technologies:
- A “cookie” is a small piece of data that is stored on a visitor’s hard drive in order to store information about visitor preferences and activities on the Site. We use this information to optimize the experiences of our visitors. For instance, a cookie can help us identify you when you return to the Site in order to save you time. You may also choose to refuse to accept cookies by configuring the appropriate setting on your browser. However, doing so may prevent you from being able to access parts of the Site or Search and may prevent the Site from functioning properly.
- Web Beacons. A “web beacon” is a small file (also known as a clear gif or pixel tag) that is embedded on a webpage, email, video, or other content that allows us to collect data about visitors who interact with such web pages or emails, such as recording when such content is accessed and reading other information from your browser. Your preferences for flash cookies are not managed in the same way as browser cookies. Instead, you may change your preferences for flash cookies by changing your settings on Adobe’s website.
- DoubleClick DART Cookies. A “DoubleClick DART cookie” is a cookie that, according to Google, Inc., “is used by Google in the ads served on publisher websites displaying AdSense for content ads. When users visit an AdSense publisher’s website and either view or click on an ad, a cookie may be dropped on that end user’s browser. The data gathered from these cookies will be used to help AdSense publishers better serve and manage the ads on their site(s) and across the web.” You may opt out of using the DART cookie by visiting the Google ad and content network privacy policy.
- Google Analytics. We may use Google Analytics or similar services to collect non-personal information from you regarding your use of the Site. Google Analytics is a web analytics service offered by Google, Inc. that mainly uses cookies to report on your interactions on the Site and analyses how you use the Site. What do we use your information for?
Any of the information we collect from you may be used in one of the following ways: to personalize your experience (your information helps us to better respond to your individual needs); to process transactions (your information, whether public or private, will not be sold, exchanged, transferred, or given to any other company for any reason whatsoever, without your consent. It is used solely for the purpose of delivering the service requested; to send periodic emails.

This Site may contain links to or from other websites. This privacy policy only applies to information collected on this Site, and we are not responsible for other website’s privacy practices. Please be aware that when you exit our Site using such links, we encourage you to review the privacy practices of all other websites you reach through links on our Site.
Security
We take the security of your information seriously and have electronic, physical, and administrative safeguards in place that comply with federal regulations for your protection. These security measures seek to protect your information both online and offline from disclosure, alteration, or unauthorized use. However, please keep in mind that no transmission of data over the internet is guaranteed to be completely secure. Third parties may be able to access private communications illegally; for instance, through the use of hacking and viruses. As such, all information you transmit on the Site or Search is at your own risk. We are not responsible for instances where third parties circumvent our security measures without authorization, illegally or otherwise. The information you submit to us is encrypted using Secure Sockets Layer (SSL) data encryption technology and is transmitted securely. You may verify this by locating “https” at the beginning of the address of the webpage or an icon of a closed lock in your browser. The computers and servers we use are also kept in a secure environment behind firewalls. We limit access to your information to those people that need to view it to perform necessary support tasks, including fulfilling your requests. We also require you to create a unique password to help secure your account. It is your responsibility to maintain the secrecy of your password and other login information. We will promptly notify you in the event that personal information becomes compromised according to our notification procedures outlined below or as otherwise required by applicable law.
Children’s Privacy
This Site does not knowingly collect personal information from children under 13 years of age. If you are under 13 years of age, do not use this Site or provide any personal information to us. We will delete all information that we discover is provided by children under 13 years of age without verification of parental consent. 2. Use of the Site and/or Services
You may only use the Site and/or Services in accordance with the Terms of Use, any posted policies and procedures that appear on the Site, and for lawful purposes. You agree not to use the Site and/or Services to: (a) transmit any material that infringes or misappropriate any third party’s copyright, trademark, trade secret, patent, or other proprietary rights, (b) transmit any material that is false, inaccurate, fraudulent, or misleading, (c) distribute computer viruses, worms, or software intended to damage or alter a computer system without the owner’s consent, (d) use “auto-responders,” “cancel-bots,” or other similar mechanisms that generate excessive network traffic, (e) transmit any unlawful, harmful, defamatory, pornographic, obscene, vulgar, threatening, harassing or otherwise objectionable material, (f) send or relay any unsolicited advertising or chain letters, (g) exceed your permitted access or attempt to gain unauthorized access to the Site and/or Services, or any part thereof, or other accounts, computer systems or networks, through
login password mining or any other means, (h) frame any portions of the Site and/or Services within another web site or establish links from any other web site to any page of the Site other than the home page or (i) resell use of, or access to, the Site and/or Services to any third party without Blackline Service’s prior written consent. Blackline Service reserves the right to terminate your access to the Site and/or Services at any time without notice if we determine, in our sole discretion, that you have abused or violated any of these terms and conditions.
3. User Registration
You are responsible for maintaining the confidentiality of any email username and/or password provided to you by Blackline Service for use in connection with the Site and/or Services. You are solely responsible for all activities that occur under your email username and/or password, and you agree to notify Blackline Service immediately of any unauthorized use of your email username and/or password or any other breach of security related to the Site and/or Services. Blackline Service will not be liable for any loss or damage arising from your failure to safeguard your email username and/or password or to comply with this section.
4. Use of Services
Blackline Service’s provision to you of the Services may be subject to other terms, conditions, and restrictions posted on the Site or otherwise communicated in writing to you by Blackline Service, including via email. The Services are subject to availability across all markets and will be deemed available through an email confirmation provided by Blackline Service. Please refer to the Frequently Asked Questions page and/or Service Agreement page for more information.
5. Payment Processing
Blackline Service uses a third-party payment processor (the “Payment Processor”) to link your credit card account to pay for the Services booked on the Site. The processing of payments or credits, as applicable, in connection with your use of the Site and/or Services will be subject to the terms, conditions and privacy policies of the Payment Processor and your credit card issuer in addition to these Terms of Use. Blackline Service is not responsible for any errors by the Payment Processor. In connection with your use of the Site and/or Services, Blackline Service will obtain certain transaction details, which Blackline Service will use solely in accordance with the Privacy Policy.
6. Payment Terms
You are responsible for all fees, including taxes, associated with your use of the Service. All fees charged to you by Blackline Service, are due in accordance with the Service Agreement on Blackline Service’s invoices and other formal written arrangements if any. Blackline Service reserves the right to determine final pricing, and, at its sole discretion, may make promotional offers with different features and different rates. These promotional offers, unless made to you, shall have no bearing whatsoever on Blackline Service’s final pricing. Blackline Service may change the fees for its Services, as it deems necessary. Please refer to our Service Agreement for further information.

Blackline Service respects your privacy. Please refer to our Privacy Policy which explains how we collect, use, and disclose information that pertains to your privacy.

9. Proprietary Rights and Communication with Blackline Service.
- (i) The Site, and certain content therein, the Services, and any underlying software may be protected by copyright, trademark, patent, and/or other intellectual property and proprietary rights laws and are owned (along with all proprietary rights therein, including all rights, in and to the Site and/or Services, and any suggestions, ideas, enhancement requests, feedback, recommendations or other information provided by you or any other party relating to the Site and/or Services) by Blackline Service and/or its licensors. You agree that you will not copy, distribute, republish, display, post, transmit, download, or modify any content you obtain from the Site and/or Services, or any other Blackline Service or licensor owned intellectual property without Blackline Service’s prior permission; provided, however, that you may download or print a copy of information from the Site for your use in learning about, reserving, or using the Services.
- (ii) Excepting any suggestions, ideas, enhancement requests, feedback, recommendations, or any other information deemed proprietary and detailed above in 4(i), any other communication or material you transmit to us by email or otherwise, including any data, questions, comments, suggestions, or the like is and will be treated as, non-confidential and non-proprietary. Except to the extent expressly covered by our Privacy Policy, anything you transmit, or post may be used by us for any purpose, including but not limited to, reproduction, disclosure, transmission, publication, broadcast, and posting. Furthermore, you expressly agree that we are free to use any ideas, concepts, know-how, or techniques contained in any communication you send to us without compensation and for any purpose whatsoever, including but not limited to, developing, manufacturing, and marketing products and services using such information.
10. Limitation of Liability
IN NO EVENT WILL BLACKLINE SERVICE, ANY OF ITS SUBSIDIARIES, PARTNERS, AFFILIATES, VENDORS OR SUBCONTRACTORS, INCLUDING THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES OR AGENTS, BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR
CONSEQUENTIAL DAMAGES (INCLUDING WITHOUT LIMITATION THOSE RESULTING FROM LOST PROFITS, LOST DATA OR BUSINESS INTERRUPTION) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SITE, THE SERVICES, OR ANY WEBSITES OR THIRD PARTY APPLICATIONS LINKED TO THE WEBSITE, THE SERVICES, WHETHER BASED ON CONTRACT, TORT OR OTHER LEGAL THEORY, AND REGARDLESS OF WHETHER BLACKLINE SERVICE
KNEW OR WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BLACKLINE SERVICE’S AGGREGATE LIABILITY FOR DIRECT DAMAGES ARISING FROM OR RELATING TO THE SITE AND/OR SERVICES (REGARDLESS OF THE CAUSE OF ACTION, WHETHER UNDER CONTRACT, TORT, OR OTHER LEGAL THEORY) IS LIMITED TO THE GREATER OF (i) THE AMOUNT PAID BY
THE USER TO BLACKLINE SERVICE FOR THE SPECIFIC SERVICE THAT IS THE SUBJECT OF THE DISPUTE OR (ii) $50. THE FOREGOING LIMITATIONS OF LIABILITY ARE INDEPENDENT OF, AND SHALL APPLY REGARDLESS OF, ANY FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED OR EXCLUSIVE REMEDY.
You acknowledge that Blackline Service has agreed to provide the Site and/ or Service in reliance on the exclusions of liability and disclaimers of warranty set forth herein. Some jurisdictions do not allow the limitation of incidental or consequential damages, so the above limitation may not apply to you.
Indemnification
You agree to indemnify and hold Blackline Service, its subsidiaries, partners, affiliates, vendors, subcontractors, officers, employees, and agents harmless from any and all losses, liabilities, damages and/or costs (including reasonable attorneys’ fees) arising from any third-party claims arising from or related to your use of the Site and/or Services, or your violation of the Terms of Use, Service Agreement and/or Privacy Policy.

Throughout these Terms of Use, Service Agreement and/or Privacy Policy, each section includes titles and brief summaries of the following terms and conditions. These section titles and brief summaries are not legally binding.
13. Severability
If any part of these Terms of Use shall be held or declared to be invalid or unenforceable for any reason by any court of competent jurisdiction, such provision shall be ineffective but shall not affect any other part of these Terms of Use.
14. Confirmations
Credit card information will be required when you make your reservation. Upon receipt of your reservation request, subject to availability, we will email your confirmation. Reservations are not valid, unless you received a confirmation email from Blackline Service. Only our office staff has the right to make and confirm reservations. Our chauffeurs are not allowed to make reservations, verbal confirmations will be void. We recommend that you make your reservation at least 48 hours prior to the actual pick-up time. However, last minute reservations are possible depending on vehicle availability. Please check your confirmation carefully. If you find any errors in the confirmation email, please contact us immediately. Our drivers will be routed by the information on the confirmation email, such as pick up address and pick up times.
15. Rates
Rates are subject to availability and may change without notice prior to making the reservation. Rates will not change once the reservation has been approved and confirmed via email. All rides after 2+ Hours will be reversed as an hourly charter. The client will be informed by Dispatch before reservation is accepted. Garage time will be applied to all long distance rides.
16. Payment Information
We will authorize your credit card as soon as the reservation is made. The card must have sufficient available funds or your reservation will be cancelled. We do not keep credit card information. We use a secure credit card gateway to process all credit card payments.
17. Excess Cleaning Fee | Vehicle Damage
If, during or after the transportation service, the company is required to expend an extended amount of time and material to clean the vehicle due to acts of the client or any passenger (i.e., spilling food & drinks, vomiting, prohibited smoking, excessive trash) , the company, at its discretion, will charge client additional fees to cover such expense. Damage to the vehicle in any way caused by actions of the client or any passenger will be charged in
full to the client. The minimum clean-up fee is US$250.
18. Property Transported
BLACKLINE SERVICE cannot assume responsibility for the handling or maintenance of any baggage or other property, nor for any property left in the company’s vehicles. We will do everything possible to secure and retrieve any belongings left in the vehicle. Please always check thoroughly prior to leaving the vehicle for all your personal belongings.
19. Cancellations
BLACKLINE SERVICE requires cancellations BY EMAIL prior to scheduled pickups. The customer may cancel a booking at any time, but unless otherwise specified in writing, the following cancellation penalties will apply:
- Bookings cancelled at least 30 days before the pick-up time will bear a 5% penalty.
- Bookings cancelled from 48 hours to at least 24 hours before the pick-up time will bear a 20% penalty.
- Bookings cancelled from 24 hours before the pick-up time or no-shows will bear a 100% penalty.
The penalty amount will be equal to the corresponding percentage of the price for the Booking.
No refund shall be given for any portion of the transfer unused by the customer, after departure of the transfer (regardless of any possible reasons).
20. Car Seats
Blackline Service provides complimentary CAR SEATS for our young travelers, please indicate what type and how many do you need when making a reservation in section INSTRUCTIONS / SPECIAL REQUESTS.
Car Seat Disclaimer: Blackline Service assumes no responsibility for any injury, or damages suffered by the user. As such, this device must be installed by the user only. Chauffeurs are neither authorized nor certified to install any type of car seat provided. For information on how to properly install this device. please refer to the instruction manual.
21. Liability
Blackline Service is not liable in the event of mechanical breakdown while on charter and will only be responsible for making up lost time at mutually agreed date. The client assumes full financial liability for any damage to the car caused by them or any members of their party. Shampoo fee is US$250. Alcohol consumption and drug use is prohibited by law. Any fines will be paid for by the customer. The driver has the right to terminate the run without
refund (if there is blatant indiscretion on the part of the client(s). Smoking is not permitted in our vehicles. Not responsible for articles left in the car. Vehicles cannot be loaded beyond seating capacity.
22. Jurisdiction and Applicable Law
The Jamaican courts will have non-exclusive jurisdiction over any claim arising from, or related to, Blackline Service. These terms of use and any dispute or claim arising out of or in connection with them or their subject matter, or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.
23. Entire Agreement
These Terms of Use and the other policies and terms posted on the site set forth the entire agreement between you and Blackline Service on this subject matter and supersede all other negotiations, understandings, statements, and agreements between the parties.
